Welcome to Summonr! These Terms of Service ("Terms") constitute a legally binding agreement between you and Summonr ("we," "us," or "our") governing your access to and use of our website at summonr.fun and our AI companion chat services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

To use the Services, you must:

• Be at least 13 years of age if you reside in the United States
• Be at least 16 years of age if you reside in the European Economic Area (EEA), United Kingdom, or Switzerland
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law

If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

We reserve the right to request proof of age at any time. If we learn that we have collected personal information from a user who does not meet the age requirements, we will take steps to delete such information and terminate the user's account.

To access certain features of the Services, you must register for an account. When you register, you agree to:

• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

• Create more than one account per person

We reserve the right to suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms.

Summonr offers both free and paid subscription plans. If you choose a paid subscription:

• You agree to pay all fees associated with your subscription plan
• Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected)
• Your subscription will automatically renew unless you cancel before the renewal date
• All fees are non-refundable except as expressly set forth in our Refund Policy
• We may change our fees upon reasonable notice; continued use after a price change constitutes acceptance
• Access to certain features, such as data export, may be restricted to paid subscriptions.

Payments are processed through third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge it for all fees incurred.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Services to harass, abuse, threaten, or harm others
• Post or transmit content that is illegal, defamatory, obscene, or pornographic
• Infringe any intellectual property or other proprietary rights of any party
• Impersonate any person or entity or misrepresent your affiliation
• Upload viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Services to engage in any fraudulent or deceptive activity
• Interfere with or disrupt the Services or servers
• Scrape, data mine, or use automated means to access the Services without permission
• Use the Services to generate content that promotes violence, hatred, or discrimination
• Use the Services to create, distribute, or facilitate child sexual abuse material (zero tolerance)
• Violate any applicable laws or regulations
• Circumvent any technological measures designed to protect the Services

We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions, including removing content, suspending or terminating accounts, and reporting to law enforcement.

The Services use artificial intelligence to generate responses and content. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or inappropriate
• We do not guarantee the accuracy, reliability, or quality of AI-generated content
• You should not rely on AI-generated content for medical, legal, financial, or other professional advice
• AI companions are fictional characters and their responses do not represent real persons or entities

You retain ownership of the content you submit to the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display such content solely for the purpose of providing the Services to you.

You are solely responsible for your User Content and the consequences of sharing it. We reserve the right to remove any User Content that violates these Terms.

The Services and all content, features, and functionality thereof (excluding User Content) are owned by Summonr and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks, logos, or branding without written consent
• Reverse engineer, decompile, or disassemble any part of the Services
• Create derivative works based on the Services

All rights not expressly granted in these Terms are reserved by Summonr.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Services will be uninterrupted, secure, or error-free
• The results obtained from the Services will be accurate or reliable
• Any defects in the Services will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUMMONR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of the Services
• Any AI-generated content or your reliance thereon

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

FOR USERS IN THE UNITED STATES:

You and Summonr agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration on an individual basis, rather than in court.

ARBITRATION AGREEMENT AND CLASS ACTION WAIVER:

• You agree to resolve disputes through binding individual arbitration
• You waive any right to participate in a class action lawsuit or class-wide arbitration
• The arbitration shall be conducted by a neutral arbitrator in accordance with established arbitration rules
• Each party shall bear its own costs, and the arbitrator's decision shall be final and binding

OPT-OUT RIGHT: You may opt out of this arbitration agreement by sending written notice to support@summonr.fun within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

SMALL CLAIMS EXCEPTION: Either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

FOR USERS IN THE EUROPEAN ECONOMIC AREA, UNITED KINGDOM, OR SWITZERLAND:

Nothing in these Terms shall deprive you of the protection afforded by mandatory provisions of consumer protection laws in your country of residence. You retain the right to bring legal proceedings in the courts of your country of residence. The arbitration clause above does not apply to you.

For users in the United States: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Service Provider is established, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the courts located in the Service Provider's jurisdiction.

For users in the European Economic Area, United Kingdom, or Switzerland: These Terms shall be governed by the laws of your country of residence. You may bring legal proceedings in the courts of your country of residence.

For users in other jurisdictions: These Terms shall be governed by the laws of the jurisdiction where the Service Provider is established, but mandatory consumer protection laws of your jurisdiction may also apply.

You may terminate your account at any time by contacting us at support@summonr.fun or through your account settings.

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice, including if:

• You breach these Terms
• We are required to do so by law
• We discontinue the Services

Upon termination:

• Your right to access the Services will immediately cease
• We may delete your account and User Content
• Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending an email to registered users (for material changes)

Material changes will become effective no earlier than 30 days after posting, except for changes addressing new features or legal requirements, which may be effective immediately.

Your continued use of the Services after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Summonr regarding the Services.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Notices: We may provide notices to you via email, posting on the Services, or other reasonable means. You may provide notices to us at support@summonr.fun.
